Acceptance of P2PNG Terms
Welcome to P2PNG ("Company", "P2PNG", "we", "us", or "our"). These Terms and Conditions ("P2P Terms") constitute a legally binding agreement between Company and each registered user (each, a "User", "you" or "your") of the P2PNG Peer-to-Peer (P2P) platform located at https://p2png.com or such other URL as may be designated by Company from time to time, as well as any mobile apps or other related services or applications thereto (collectively, the "P2PNG Platform").
P2PNG Platform is considered part of the P2PNG Services. The P2PNG Terms of Use are incorporated by reference into these P2P Terms and also govern your use and access of the P2PNG Platform. In the event of a conflict between these terms and the P2PNG Terms of Use, the P2P Terms will supersede and control.
Please carefully review these P2P Terms. By accessing and using the P2PNG Platform (including placing orders and releasing digital assets), you are deemed to have read, accepted, executed, and agreed to be bound by these P2P Terms. We may change or amend the P2PNG Platform or these P2P Terms at any time at our sole discretion. Any changes to these P2P Terms will be in effect as of the "LAST REVISED" date shown at the top of this page. You acknowledge and agree that the form and nature of the P2PNG Platform may change from time to time without prior notice, and that we may add or remove features and modify any part of the P2PNG Platform.
IF ANY PROVISION OF THESE P2P TERMS OR THE P2PNG TERMS OF USE OR ANY FUTURE CHANGES ARE UNACCEPTABLE TO YOU, DO NOT USE OR CONTINUE TO USE THE P2PNG PLATFORM. YOUR CONTINUED USE FOLLOWING THE POSTING OF ANY NOTICE OF CHANGES SHALL CONSTITUTE YOUR ACCEPTANCE OF SUCH CHANGES.
ARBITRATION NOTICE: THE P2PNG TERMS OF USE CONTAIN AN ARBITRATION CLAUSE. EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THAT CLAUSE, YOU AND COMPANY AGREE THAT DISPUTES BETWEEN US WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU AND COMPANY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Overview of P2PNG Platform
We provide a platform for you to directly trade digital assets with counterparties. Buyers and sellers can broadcast their offers. P2PNG acts as a facilitator of the transaction. Once the offline fiat asset exchange is confirmed by both parties, we release the digital assets to the buyer.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT GUARANTEES, REPRESENTATIONS, OR WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, P2PNG DISCLAIMS ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
P2PNG DOES NOT GUARANTEE CONTINUOUS, UNINTERRUPTED OR ERROR-FREE ACCESS TO THE PLATFORM. WE ARE NOT LIABLE FOR DISRUPTIONS OR LOSSES A USER MAY EXPERIENCE. YOU ACKNOWLEDGE THAT YOU HAVE NOT RELIED ON ANY STATEMENT OR UNDERSTANDING OTHER THAN WHAT IS CONTAINED IN THESE TERMS.
YOU ACCEPT THE INHERENT RISKS OF USING DIGITAL CURRENCY, INCLUDING BUT NOT LIMITED TO HARDWARE FAILURE, SOFTWARE ISSUES, INTERNET CONNECTIVITY, MALWARE, THIRD-PARTY INTERFERENCE, DATA LOSS, OR SERVER FAILURE. P2PNG WILL NOT BE RESPONSIBLE FOR ANY COMMUNICATION FAILURES OR ERRORS YOU MAY EXPERIENCE.
IN NO EVENT SHALL P2PNG, ITS AFFILIATES, SERVICE PROVIDERS, OFFICERS, DIRECTORS, AGENTS, EMPLOYEES, CONSULTANTS OR REPRESENTATIVES BE LIABLE (A) FOR MORE THAN THE TOTAL FEES PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRIOR TO THE EVENT OR (B) FOR LOST PROFITS, DATA LOSS, LOSS OF VALUE, OR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY.
THIS LIMITATION DOES NOT APPLY IN CASES OF GROSS NEGLIGENCE, FRAUD, WILLFUL MISCONDUCT, OR INTENTIONAL LAW VIOLATION.
When using our Services, you may encounter content or services provided by third parties ("Third Party Content"). We do not endorse or control such content. Your dealings with third parties are solely between you and those third parties. We are not liable for any loss or damage resulting from such interactions, which are at your own risk.
